Legal framework
County Court Judgments can be set aside under CPR Part 13 if judgment was entered in default and the defendant has a real prospect of defending the claim, or if there is some other good reason to set aside. CPR Part 39.3 covers setting aside judgments made at a hearing the defendant did not attend. Applications are made using Form N244 and typically require a witness statement explaining the delay and setting out the proposed defence. A court fee of £313 applies (unless you qualify for Help with Fees). If the CCJ has been paid within one calendar month, it can be removed from the Register of Judgments by applying to the court with proof of payment.
